Terms & Conditions

These Terms & Conditions govern the web design and development services provided by The Atom Studio (“we”, “us”, or “our”), operating from Colombo, Sri Lanka via studio.theatom.lk. By engaging our services or making a payment, you (“the client”) agree to these terms. Specific project details are set out in the individual quotation or proposal we provide, which forms part of our agreement with you.

1. Scope of Work

The services, deliverables, and price for each engagement are defined in a written quotation or proposal prepared for that project. Work outside the agreed scope — additional pages, features, or revisions beyond those specified — may be quoted separately before it is carried out.

2. Client Responsibilities

Timely delivery depends on your cooperation. You agree to:

  • Provide accurate project requirements, content, text, images, and other materials we need;
  • Give feedback, clarifications, and approvals within a reasonable timeframe;
  • Ensure you have the rights to any content you supply to us for use in your project.

Delays in providing materials, feedback, or approvals may affect timelines and delivery dates.

3. Timelines

Any dates or durations we share are good-faith estimates, not guarantees. Project timelines depend on the agreed scope, the complexity of the work, and the timeliness of your feedback and content. We will keep you informed of meaningful changes to the schedule.

4. Revisions

Each quotation specifies the number of revision rounds included for the agreed scope. We welcome your feedback and will refine the work within those rounds. Additional revisions, or changes that alter the agreed scope, may be charged at our standard rates and quoted in advance.

5. Intellectual Property

Ownership of the final deliverables transfers to you upon full payment of all applicable fees. Until then, all work produced remains our property. Any third-party assets, fonts, plugins, or licensed components are subject to their own licences. Unless we agree otherwise in writing, we reserve the right to display and reference completed work in our portfolio and marketing materials.

6. Payment Terms

  • Fees are set out in the quotation or invoice for each project;
  • Projects typically begin after an agreed deposit is received, with the balance due at agreed milestones or on completion;
  • Card payments are processed securely through PayHere. We do not store your card details;
  • Unless stated otherwise, amounts are quoted in Sri Lankan Rupees (LKR); the applicable currency for each engagement is confirmed in your quotation.

7. Cancellations & Right to Refuse

We reserve the right to decline or discontinue a project where it falls outside our expertise, conflicts with our values, or where the working relationship becomes unworkable. Cancellations and any resulting refunds are handled in accordance with our Refund Policy.

8. Limitation of Liability

We provide our services with reasonable skill and care. To the fullest extent permitted by law, The Atom Studio is not liable for any indirect, incidental, or consequential loss arising from the use of our services or deliverables. Our total liability for any claim will not exceed the fees paid for the specific project giving rise to the claim.

9. Governing Law

These terms are governed by the laws of Sri Lanka, and any disputes are subject to the jurisdiction of the courts of Sri Lanka.

10. Amendments

We may update these Terms & Conditions from time to time. The current version is always available on this page, with the “Last updated” date reflecting the latest revision. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
